General Terms & Conditions (AGB)

Provider

Scope of Application

These terms apply to all orders placed at our food truck (in person or via our website), online pre-orders for pickup, and catering bookings. By placing an order, you agree to these terms. We only offer our services to consumers within the meaning of § 13 BGB.

Contract Formation

A contract is formed as follows:

• At the food truck: the contract is formed when you place your order and we confirm it
• Online pre-orders: your order is an offer to purchase; the contract is formed when we send an order confirmation by email
• Catering bookings: the contract is formed when we confirm your booking request in writing (email)

Prices & VAT

All prices shown on our menu, website, and promotional materials are final prices in euros (EUR) and include the applicable German value-added tax (Mehrwertsteuer). For food sold at the truck for immediate consumption, the reduced VAT rate of 7% applies. For catering services, the standard VAT rate of 19% may apply.

Payment

Payment is due at the time of purchase or upon pickup of pre-orders. We accept the following payment methods:

• Cash (EUR)
• EC card / debit card (Girocard)
• Credit card (Visa, Mastercard)
• Contactless payment (Apple Pay, Google Pay)
• PayPal (for online pre-orders)

Pickup & Collection

Online pre-orders are prepared for the selected pickup time. Please collect your order within 15 minutes of the confirmed pickup time. After 30 minutes, uncollected orders may no longer be available, and no refund will be issued for orders not collected on time. AuthIndisch is not responsible for quality loss due to late pickup.

Catering Terms

For catering and event bookings, the following additional terms apply:

• A deposit of up to 50% may be required upon booking confirmation
• Final guest count and menu selection must be confirmed at least 5 days before the event
• Cancellation more than 7 days before the event: full deposit refund
• Cancellation 3–7 days before: 50% deposit refund
• Cancellation less than 3 days before: no refund
• AuthIndisch reserves the right to cancel in case of force majeure (e.g. severe weather, vehicle breakdown) with a full refund

Right of Withdrawal (Widerrufsrecht)

In accordance with § 312g Abs. 2 Nr. 2 BGB, there is no right of withdrawal for contracts involving the delivery of goods that can spoil quickly or that have a short expiry date. This applies to all freshly prepared food from AuthIndisch. For catering bookings, the right of withdrawal expires once we begin preparation for your event.

Refunds & Complaints

For detailed information about our refund policy, please see our Refund & Cancellation Policy. If you are not satisfied with your food, we are happy to offer a full refund.

Liability

AuthIndisch is liable in accordance with statutory provisions for damages caused by intent or gross negligence. For slight negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations), limited to foreseeable, typical damages. This does not apply to liability for injury to life, body, or health, or under the German Product Liability Act (Produkthaftungsgesetz).

Food Safety & Allergens

We comply with all applicable German and EU food safety regulations (LMHV, EU Regulation 852/2004). Allergen information is available on request at the food truck and on our website. Despite careful preparation, cross-contamination cannot be fully excluded. Please inform us of any allergies or intolerances before ordering.

Website Use

The content on our website is provided for general information purposes. We make reasonable efforts to keep information accurate and up to date, but we do not guarantee the completeness or accuracy of the content. Photos of menu items are for illustration only and may differ from what is served.

Governing Law & Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Jena, insofar as legally permissible. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. If any provision of these terms is or becomes invalid, the remaining provisions shall remain in full force and effect.

Changes to These Terms

We reserve the right to amend these terms at any time. Changes will be published on our website. The version valid at the time of your order applies.
